Chapter 7 Bankruptcy Filing
Bankruptcy is designed for debtors in financially difficult situations who do not have the ability to pay their existing debts. Over 1 million people file for personal Bankruptcy every year. The most common personal filing for Bankruptcy is done under Chapter 7 of the Bankruptcy Code. We The People provides the legal document assistance to help make the filing for Bankruptcy process without an attorney as affordable and stress free as possible. If your situation is fairly simple this will save you enormous money.
Bankruptcy laws differ state to state, however, every state has laws to protect certain property, such as clothing, household items, money in qualified retirement plans, your car and your house (up to a certain value).
Bankruptcy Petition Preparers
Many people choose to file for Bankruptcy “Pro se”, that is, without a lawyer. A “Bankruptcy Petition Preparer” is a non-attorney who assists people in preparing their Bankruptcy documents by providing commercially available general resources and typing all paperwork in accordance to the court’s standards and guidelines. Because “Bankruptcy Petition Preparers” are not lawyers they cannot provide any legal advice. By law, “Bankruptcy Petition Preparers” are considered to be “debt relief agencies” and help people file for relief under the Bankruptcy Code.
Final Order or Discharge in Chapter 7 Bankruptcy
The final order or discharge in Chapter 7 Bankruptcy releases the debtor from any personal liability for certain types of debt. This includes, but is not limited to, credit card payments, medical bills and personal loans. Once the bankruptcy has been discharged, the debtor is not legally responsible to pay back any outstanding balances and those debts are eliminated. This is a legal order prohibiting creditors from taking any action in collecting discharged debts from the debtor, including legal action and communication.
